Software Terms of Use

Xavier Pitel solely and exclusively owns the title, copyright and other intellectual property rights in the Software provided on this Website, as expressly provided for in these Terms of Use.

“Software” means all Adobe or Macromedia extensions for Dreamweaver® (“.mxp” files), Microsoft® Word add-ons (“.dot” files), including upgrades, installation files, documentation, associated media and license agreements provided on this Website.

By installing, copying or otherwise using the Software, you agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, do not install, copy or use the Software.

1. License

Free software:
The End User may use for an unlimited period of time the Software and its documentation provided for free on this Website. The End User may copy and distribute copies of this Software and documentation, provided that each distributed copy includes these Terms of Use and reproduces all due titles and copyrights for this Software, as well as a link to this Website. The End User may never sell this Software, nor use them to marketing or similar purposes.

Other software:
The End User buys only the right to install and use for an unlimited period of time the Software and its documentation for its personal use. The license granted concerns the use of each piece of Software on a single computer at a time. The Software may be moved from on computer to another, but may not be installed or used concurrently on different computers. The right to use the Software is granted only to one End User (person or company). Except for the right to use the Software, the End User agrees that Xavier Pitel owns all rights on the Software and that the End User is bound not to use the Software in any other way. The End User is not entitled, for instance, to rent, lease or make copies of the Software to third parties, nor to freely distribute or sell them.

2. Intellectual property rights

The Software and its documentation are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

Free software:
As such, the End User agrees not to modify, translate, disassemble, nor adapt the Software and its documentation.

Other software:
As a consequence, the End User agrees not to make copies of the Software and its documentation, except to make one copy of the Software in machine-readable form solely for backup purposes, and agrees not to modify, translate, disassemble nor adapt the Software and its documentation.

3. Limited warranty

Xavier Pitel warrants that the Software will perform substantially in accordance with the accompanying documentation, but does not warrant that the Software is error-free. Xavier Pitel does not warrant that the Software will meet the End User specific requirements. It is up to the End User to assess if the Software functionalities will meet the End User specific needs. Xavier Pitel shall not be liable for any direct, indirect, consequential or other damages whatsoever arising out of or in any way related to the use of or inability to use the Software.

4. Applicable law

These Terms of Use are governed by the laws of France and the courts of the French Republic. The End User consents to the exclusive jurisdiction and venue of the court of Aix-en-Provence, France to resolve any disputes arising under these Terms of Use.
